美國移民之路愈來愈難

審查趨嚴、程序改變　合法移民也面臨更多不確定性

美國移民政策正在快速改變。對許多希望合法留在美國、取得工作簽證、綠卡甚至公民身分的移民而言，今天面對的已不只是「等待時間長」，而是整個審查制度變得更加嚴格、複雜，也更難預測。

自2025年以來，美國政府加強對外國人的背景審查，包括簽證、永久居留、工作許可及其他移民福利。路透社今年7月報導，新的審查措施已造成部分簽證處理延誤與企業聘僱上的不確定性；申請人的社交媒體紀錄、家庭資料及其他背景資訊，也可能受到更深入的審查。

進入2026年後，這種趨勢更加明顯。美國公民及移民服務局（USCIS）8月5日宣布進一步強化移民申請的證據標準，政策自當日起對相關新申請及仍在審理中的案件生效。這意味著申請人在送件之初，就更需要準備完整、可信而且前後一致的證明資料。

另一個重大變化，是部分在美國境內希望取得綠卡的人，可能面臨必須離境、透過美國國務院海外領事程序辦理的情況。今年5月，USCIS公布相關政策，強調部分臨時身分人士若希望取得永久居留，原則上應回到海外辦理，特殊情況則個案考量。

簽證政策同樣更加嚴格。美國國務院今年1月21日起暫停向一批指定國家的國民核發移民簽證；這些申請人仍可以提出申請和參加面談，但簽證核發受到限制。

政府方面認為，加強審查有助於防止欺詐、維護國家安全，並確保移民制度依法律規定運作。另一方面，移民律師、企業以及移民權益團體則擔心，過度複雜的審查可能造成更長的等待時間，使學生、專業人才、家庭團聚者及企業雇主都難以規劃未來。

今天的移民問題，已不再只是非法入境或邊境問題。合法移民本身，也正在面對一個門檻更高、審查更細、程序更難預測的新時代。

對所有正在申請簽證、綠卡、工作許可或公民身分的人而言，最重要的是：不要再按照幾年前的經驗準備案件。表格、證據要求以及政策可能隨時改變，在遞交文件之前應核對最新的USCIS及美國國務院規定；涉及個人案件時，更應取得合格移民律師的專業意見。

美國仍然是一個移民國家，但進入美國、留在美國以及成為美國人的道路，正在變得更加艱難。

America’s immigration system is changing rapidly. For many people who hope to remain legally in the United States, obtain a work visa, secure a green card, or eventually become U.S. citizens, the challenge is no longer simply a long waiting period. The entire process has become more complicated, more restrictive, and increasingly difficult to predict.

Since 2025, the U.S. government has strengthened background screening for foreign nationals seeking visas, permanent residency, work authorization, and other immigration benefits. Applicants may face closer examination of their personal history, family information, travel records, social media activity, and supporting documents.

In 2026, the trend toward tougher enforcement and stricter review has become even more apparent. Immigration authorities have reinforced evidentiary standards, placing greater responsibility on applicants to provide complete, accurate, credible, and consistent documentation from the beginning of the application process.

For some people seeking permanent residency from within the United States, the path may also become more complicated if they are required to complete part of the process through a U.S. consulate abroad. Such changes can create additional financial burdens, travel concerns, family separation, and uncertainty.

Visa applicants are also facing a more demanding environment. Depending on nationality, immigration category, individual background, and changing government policies, some applicants may experience additional screening, delays, or restrictions.

The government argues that stronger screening is necessary to prevent fraud, protect national security, enforce immigration laws, and maintain the integrity of the system. At the same time, immigration attorneys, businesses, universities, families, and immigrant communities are concerned that increasingly complicated procedures may make it more difficult for students, skilled professionals, employers, and families to plan their futures.

Today, America’s immigration debate is no longer only about illegal border crossings. Legal immigration itself is entering a new era of higher barriers, deeper scrutiny, and greater uncertainty.

Anyone applying for a visa, green card, work permit, or U.S. citizenship should no longer rely solely on procedures or experiences from several years ago. Forms, documentation requirements, interview practices, and government policies can change. Applicants should carefully review the latest official requirements before filing and seek qualified immigration legal advice when an individual case involves significant complications.

America remains a nation built by immigrants. But for many people today, the road to entering America legally, remaining here, and eventually becoming an American is becoming increasingly difficult.
